An Easy Way to Create a Claim for Retaliation

Tell an employee who complains of harassment that they are fired because they are “causing too many problems” for the employer.  That is exactly what a Dairy Queen supervisor told an 18-year-old female employee when he fired her after she was subject to harassment so severe that her mother called the police to file a harassment complaint.  What happened?  The employer was sued by the EEOC and ultimately paid to settle the harassment and retaliation claims for $17,500 (which amount likely reflected the fact that the employee only worked for 4+ months).  The employer also agreed to redistribute its anti-harassment policy, conduct training, post a notice about the settlement and report future harassment and retaliation complaints directly to the EEOC.   http://eeoc.gov/eeoc/newsroom/release/10-22-12.cfm
