The City of Portland recently enacted a paid sick leave ordinance that requires employers in the City of Portland with 6 or more employees to provide eligible employees with 40 hours of paid sick leave per calendar year. Employers with 5 or fewer employees must provide 40 hours of unpaid sick leave per year. http://www.portlandonline.com/fritz/index.cfm?c=49205&a=439978.
However, the ordinance applies only to employers who do not already have a PTO or Sick Leave policy that provides equivalent benefits. The ordinance expressly states that employers that have a PTO or Sick Leave policy that provides employees with accrual of paid sick time in excess of, or equivalent to, the new ordinance are compliant with the new law.
Accordingly, while employers in the City of Portland who do not provide Sick Leave or PTO will need to adopt policies to comply with the ordinance, employers with existing Sick Leave or PTO policies may not have to take any action other than to review their policies to insure employees are receiving benefits at least equal to those provided in the ordinance.
