Oregon & DOL Sign Misclassification MOU

On April 4, 2016, BOLI and the DOL signed a three-year Memorandum of Understanding intended to protect employees’ rights by preventing misclassification of employees as independent contractors.   According to the DOL: “The two agencies will provide clear, accurate and easy-to-access outreach to employers, employees, and other stakeholders; share resources and enhance enforcement by conducting coordinated investigations and sharing information consistent with applicable law.”

Although it is unclear what the MOU will mean to Oregon employers from a practical standpoint, the announcement of BOLI and the DOL’s joint effort should motivate employers to audit  current relationships with contractors, and to carefully analyze facts and circumstances before entering into new agreements with independent contractors to avoid liability for misclassification.
