Update on EEO-1 Pay Data Reporting

Our last post discussed the US District Court decision requiring employers to submit employee pay data as part of their EEO-1 reporting obligation.  On March 19th, based on apparent agency inaction since that date, the Court ordered the EEOC and the Office of Management and Budget (OMB) to inform employers by April 3, 2019 if they will have to report pay data (aka Component 2 data) by the May 31, 2019 deadline for submission of EEO-1 reports on race/ethnicity and gender (aka Component 1 data).  Right now, the EEOC portal for filing Component 1 data is open.  By April 3rd, we will know whether the EEOC/OMB will extend the deadline for submission of Component 2 data or take other steps to address employers’ obligations with respect to Component 2 data.
