The DOL has added Covid-19 related guidance under the FLSA and FMLA.
The FLSA guidance includes answers about pay for telework, job duties for remote workers, pay for flexible work from home schedules, hazard pay, and salary reductions for exempt employees.
The FMLA guidance addresses a number of questions, including whether leave taken by an employee for the purpose of avoiding exposure to COVID-19 is protected under the FMLA (it is not). And, whether telemedicine visits will be considered in-person visits for purposes of obtaining a certification to establish a serious health condition under the FMLA (until 12/31/2020, telemedicine visits are sufficient provided the visit includes a virtual examination, evaluation, or treatment by a health care provider, and an electronic signature).
The DOL has previously provided FFCRA guidance which includes an on-line tool for employees to determine FFCRA eligibility, Fact Sheets, FAQs, and workplace posters.
